Senate CLARITY Act Stalls as SEC Advances Crypto Rulemaking
The U.S. Senate’s Digital Asset Market CLARITY Act failed to advance in a procedural vote on September 15, 2026. The outcome halted the bill’s immediate progress but does not establish that the legislation has been permanently abandoned.
Regulatory activity has continued at the agency level. In August, the Securities and Exchange Commission proposed Regulation Crypto Assets, which includes offering exemptions and a conditional safe harbor for certain crypto-asset investment contracts.
On September 17, the SEC also issued temporary conditional exemptive relief for certain distributed-ledger trading venues. These measures may shape the near-term operating environment for parts of the crypto market while broader legislation remains unresolved.

It would be premature to treat agency initiatives as a permanent replacement for the CLARITY Act. SEC Chairman Paul Atkins has said legislation remains indispensable and that the agency supports advancing the act.
Procedural vote blocks immediate progress
The September 15 Senate procedural vote prevented the CLARITY Act from moving forward at that stage. The verified result is a failure to advance, rather than a final determination on the bill’s future.
The legislation therefore remains an unresolved policy issue. Its prospects could depend on future congressional action, which is not established by the procedural vote alone.
SEC proposal sets out potential exemptions
The SEC’s proposed Regulation Crypto Assets would introduce a regulatory framework that includes offering exemptions and a conditional safe harbor for certain crypto-asset investment contracts.
A proposal is not the same as enacted legislation. Its relevance is that the SEC is continuing to develop an agency-led approach while Congress has not advanced the CLARITY Act.
Temporary relief for distributed-ledger venues
The SEC’s September 17 order granted temporary conditional exemptive relief for certain distributed-ledger trading venues. The action is distinct from the August proposal and applies under conditions set by the order.

The relief provides a current agency action, but its temporary and conditional nature means it should not be presented as a complete, durable substitute for a statutory market-structure framework.
Legislation remains part of the policy debate
Atkins has stated that legislation remains indispensable and that the SEC supports delivering the CLARITY Act. That position conflicts with a definitive narrative that agency actions have replaced the bill.
The immediate picture is a combination of stalled Senate legislation and continuing SEC rulemaking and relief measures. Whether those agency actions become a lasting framework remains an interpretation, not an established outcome.
