Lummis Blames Democrats After Senate CLARITY Act Vote Fails

Sen. Cynthia Lummis has blamed Senate Democrats for the failure of the Digital Asset Market Clarity Act to advance, arguing that their opposition to President Donald Trump took precedence over support for the crypto market-structure bill.

The Senate voted 49-50 against invoking cloture on the motion to proceed to H.R. 3633, the Digital Asset Market Clarity Act, on September 15. The result prevented the measure from moving forward at that stage.

The dispute reflects competing accounts of why the legislation stalled. Lummis said Democrats chose hostility toward Trump over the bill, while Democrats said stronger ethics restrictions tied to Trump’s crypto interests were needed and some remained open to further negotiations.

Lummis assigns blame for stalled legislation

Lummis said Democrats had chosen opposition to Trump over advancing crypto market-structure legislation. She also urged the crypto industry to hold Democrats responsible for the bill’s failure.

That is Lummis’s characterization of the vote rather than a consensus explanation. The Senate’s recorded action was a failed cloture vote on the motion to proceed, with 49 senators voting in favor and 50 against.

Democrats cite ethics safeguards

Democratic opponents of the bill said it lacked sufficiently strong ethics safeguards concerning Trump’s crypto investments, according to reporting by The Associated Press.

Their position differed from Lummis’s framing: rather than rejecting crypto legislation outright, some Democrats indicated they could remain open to negotiations. The available evidence does not establish whether or when those talks could produce a revised bill.

The debate places crypto policy alongside broader political questions about conflicts of interest and oversight. It also follows heightened political activity around digital-asset policy, including Fairshake plans $30 million campaign opposing Sherrod Brown’s Ohio Senate bid.

What the vote means

The September 15 vote did not invoke cloture on the motion to proceed to H.R. 3633. As a result, the Digital Asset Market Clarity Act did not advance through that procedural step.

Any path forward would require lawmakers to resolve the disagreement over ethics provisions as well as build the votes needed for Senate action. Lummis’s comments underscore the partisan divide, while Democrats’ stated openness to negotiations leaves room for further discussions.
