OpenAI Faces Privacy Complaint Over Chatbot Accuracy

OpenAI is under scrutiny as Noyb, a data rights protection group, files a complaint regarding inaccuracies in its ChatGPT chatbot responses.
OpenAI, a leader in AI development, is facing a privacy complaint from Noyb, a data rights advocacy group based in Austria. The complaint, filed on April 29, alleges that OpenAI has failed to address inaccuracies generated by its AI chatbot, ChatGPT, potentially violating EU privacy regulations.
The complaint stems from an incident involving an unidentified individual who sought information about themselves from OpenAI chatbot. Despite requests for rectification or deletion of the inaccurate data, OpenAI reportedly cited technical limitations and declined to take action. Additionally, the company refused to disclose details about its training data and origins.

Maartje de Graaf, a data protection lawyer at Noyb, emphasized the importance of technology adhering to legal standards, stating that systems unable to produce accurate and transparent results should not be used to generate personal data.
Noyb has escalated the complaint to the Austrian data protection authority, urging an investigation into OpenAI data processing practices and mechanisms for ensuring the accuracy of personal data processed by its large language models.
De Graaf highlighted the challenges companies face in aligning chatbot technologies like ChatGPT with EU data protection laws. Noyb, also known as the European Center for Digital Rights, operates from Vienna, Austria, with a mission to support European General Data Protection Regulation laws.
This incident adds to growing concerns surrounding the accuracy and compliance of chatbot technologies. In a similar context, Microsoft Bing AI chatbot, now Copilot, faced issues providing misleading information during political elections in Germany and Switzerland in December 2023. Google Gemini AI chatbot also faced criticism for generating inaccurate imagery, prompting the company to commit to model updates.
