CFTC Proposes Defining Certain Event Contracts as Swaps

The Commodity Futures Trading Commission announced a Notice of Proposed Rulemaking on October 9 that would expressly define certain event contracts as swaps.

The proposal covers contracts tied to sports, political, cultural and weather-related events. The CFTC said the rulemaking is intended to clarify that these products fall within the agency’s regulatory jurisdiction.

The notice is a proposal rather than a final rule. Market participants and other members of the public will have an opportunity to submit written comments after the NPRM is published in the Federal Register.

The proposed rule addresses the treatment of certain event contracts under the definition of a swap. According to the CFTC’s announcement, the identified categories include contracts based on sports, politics, cultural events and weather.
